Nobody likes reading legal paperwork so we've tried to make these terms and conditions as easy to read as possible. We've laid them out in an FAQ style, so it should be easy for you to find any points you're interested in. In this document we refer to "us" meaning Stratajet, and "you" as the client. We refer to "guests" or "passengers" to mean anybody who is on the passenger manifest for a given flight, or you have asked us to arrange transport for.
Accepting these terms and conditions means you intend for Stratajet to act as your broker for the services described in your quote documentation and final customer itinerary, on your behalf with third party air charter suppliers.
How does booking with Stratajet work?
You can request a quote for a service at any time, and subject to our acceptance and availability, we will aim to provide you a quote as quickly as possible.
We will provide you with a written quote, which will be sent to you by email, fax or will be presented to you on-screen in your web browser. This will include a quote confirmation number and a price. It will specify the date(s) and departure time of travel, the journeys we are prepared to arrange on your behalf, the aircraft type and other requests specified by you.
The quote may offer several options for you to consider for the same journey. These options might involve different aircraft, using different airfields or access to different facilities on the aircraft or at the airport. If you have any questions about these options, you can talk them through with us at any time.
To book you simply let us know you're happy to proceed. You will need to sign and return a copy of the quote, and this signifies confirmation of all of its contents and your consent to these terms and conditions.
We will then send you an itinerary confirming your choices, also by email, fax or on-screen in your web browser. It will simply confirm the choices you've made from the options we've presented to you, and re-confirms the date(s) and departure time of travel, the journeys we have arranged on your behalf, the aircraft type and other services or requests you made at the time of booking.
What happens if I cancel?
Cancellations must be made in writing by email, fax or post to be considered a valid cancellation.
If you cancel any part of, or a whole reservation within 48 hours of the beginning of a domestic journey, or 72 hours of an international journey, this may result in a cancellation charge of up to 100% of the quoted price for the trip.
You will not be charged for journeys cancelled more than 48 hours prior to departure of a domestic trip and 72 hours of an international trip.
If you're a new customer, or you have cancelled with us in the past, we may ask you to pay a deposit before we confirm the booking that is non-refundable in the event of any cancellation at any time.
What happens if I just need to change the dates or times of travel or how many passengers need to travel?
At the time you make your request for a quote with us, we will try and understand how flexible you might need to be in terms of times or dates of departure or arrival, and the type of aircraft you would prefer. It is important you highlight any issues you feel you might have with meeting a certain departure time precisely.
Whilst we will try and be as flexible as possible in accommodating changes, we reserve the right to consider any adjustment in dates, times, itineraries, or the type of aircraft as a cancellation. All one-way reservations are non-cancellable and non-refundable at the time of booking.
Is the price I get quoted, what I pay?
Yes. Most brokers and aircraft charter suppliers will put in caveats about how you will be liable for extra costs they incur. Stratajet's business model means we can eliminate that for most normal operations.
We will calculate all the costs in order to make your journey happen and provide them to you. These costs include:
- Aircraft hire
- Crewing the aircraft
- Fuel
- Repositioning flights the plane needs to make before or after your journey
- Airport and handling fees
- Any passenger or aviation taxes
- Over-flight permits
- Catering costs where applicable
- Customs fees
- Ground transportation
- Crew trip expenses
- De-icing if needed
If you make any modifications to your itinerary, we will advise you if these changes will incur any additional fees. Where we think a delay in departure might lead to such a fee, we will do our best to tell you in advance.
The only time we will ask you to pay more after the flight has happened, is if we or our suppliers have had to pay a fine, penalty or other excess as a result of you causing that fee to payable as a result of your actions. An example of this might be a fine payable on you arriving without appropriate travel documentation for your destination.
When do I pay?
We require cleared payment in advance of travel by bank wire. Where additional charges are incurred as above, we will add interest at 8% above the Bank of England base rate if the payment is not made within 30 days of us issuing you an invoice.
When booking, we may require that you provide us your credit card details. We will only charge this card if we do not receive a wire transfer within 24 hours of the booking being made.
Who operates the aircraft? Are they Stratajet aircraft?
Stratajet is a broker, and does not own or operate any aircraft, nor are we a licensed air carrier. We do not operate the flights under our own aircraft operations certificate, but work with licensed and regulated air charter suppliers on your behalf. The air charter suppliers have all responsibility, liability and control of the flights we provide to you.
Air charter suppliers have final responsibility in relation to aircraft availability, commencement and termination of flights, the operation, regulation condition and safety of the flight, baggage and cargo and other people associated with your travel, including crew performance and catering services.
We work very hard with our suppliers to make sure your needs are met first and foremost, but sometimes aircraft are unable to fly for reasons relating to weather, maintenance requirements or crew availability. We will work to reasonably minimise the impact this will have on you, however by accepting these terms and conditions you acknowledge and agree that air charter suppliers and their flight crew will be solely responsible for all decisions regarding safety determinations with respect to commencement, operation and termination of flights.
What happens when I travel?
You can arrange for travel to the airport with us if you wish. Otherwise, you should be at the airport in good time for departure and to meet your crew, and no later than we indicate is your latest departure time.
As your departure time approaches, we will be monitoring weather conditions and other information that may delay, interrupt or cancel your flight and we will work to minimise any disruption as much as reasonably possible. We may ask you to arrive at the airport a little earlier than planned, and if you are unable to do so there may be a delay or cancellation to your flight.
It is important that you realise that advertised departure and arrival times we provide in your itinerary are estimates only, and not guaranteed.
You are responsible for making sure you have obtained and have with you all required travel documents and visas. You are also responsible for complying with all laws, demands and travel requirements of countries to be flown from, into or through which you transit. We and our air charter suppliers will not be liable for the consequences from your failure to obtain such documents or visa or permissions.
Before boarding the aircraft, the air charter supplier or flight crew may ask you to submit yourself, baggage or cargo to a security check. This security check may involve a search, X-Ray, or other type of scan be to make of your person and luggage or cargo. If you are not available, your baggage or cargo may be searched in your absence. If you are unwilling to comply with a search request, the air charter supplier may refuse to carry you or your baggage or cargo. In the event of a search or scan causing damage to you or your property, neither we nor the air charter supplier will be liable for such damage unless due to fault or negligence on our part.
If during the flight, your plane must divert from its original destination, we will endeavour to make all reasonable and appropriate arrangements to get you to your final destination.
Can the flight crew refuse to fly me?
We may refuse to carry you or your baggage or cargo if one or more of the following have occurred, or we reasonably believe may occur:
a. We must refuse to carry you or your baggage or cargo in order to comply with any applicable laws, regulations or orders
b. The carriage of you, your baggage or cargo may endanger or affect the safety, health, or materially affect the comfort of other passengers or crew or be in excuse of the maximum allowable number of passengers or weight
c. Your mental or physical state, including your impairment from alcohol or drugs, presents a hazard or risk to yourself, to other passengers, to crew or to property
d. You have conducted misconduct on a previous flight and have reason to believe such misconduct will be repeated
e. You refuse to submit to a security check
f. You do not appear to have valid travel documents, you may seek to enter a country through which you may be in transit, or for which you do not have valid travel documents, destroy your documentation during the flight or refuse to surrender your travel documents to the flight crew, against receipt, when requested
g. You fail to observe our, the air charter supplier's, or the flight crew’s instructions with respect to safety or security
h. You have previously committed one of the acts or omissions referred to above
We and our air charter suppliers expect whilst on board that you, your agents, your employees, passengers or guests will behave with exemplary conduct and abide by all instructions given by the flight crew.
If in the flight crew's opinion any person on board is conducting themselves in a way that may endanger the aircraft or any person or property on board, or obstruct the crew in performing their duties or fail to comply with any instruction given by the crew, including but not limited to those with respect to smoking, alcohol or drug consumption, the flight crew may take any such measures they deem necessary, including restraint.
Is there anything not allowed on board?
You must not include in your baggage or cargo without our and the air charter supplier's express written consent or prior arrangement any compressed gases, corrosives including acids and wet batteries, explosives, munitions, fireworks and any other object which is easily ignited; flammable liquids and solids (such as flammable aerosols, lighter or heating fuel, matches), oxidising materials; poisons; radioactive materials; other restricted articles (such as mercury, magnetic materials, offensive or irritating materials).
For safety reasons we or the air charter supplier or flight crew may forbid or limit operation aboard the aircraft of electronic equipment, including (but not limited to), cellular telephones, laptop computers, portable recorders, radios, personal audio equipment, electronic games or transmitting devices including radio controlled toys and walkie-talkies. Operation of hearing aids and heart pacemakers are allowed, however you should make the flight crew aware of any such equipment prior to boarding.
What about "acts of God" or "Force Majeure"?We pride ourselves on offering exemplary customer service, however there are caveats and limits to what we can reasonably be expected to agree to and limits to the liability and responsibility that we will accept when acting as your broker.
Stratajet will not be deemed to be in breach of its obligations hereunder or have any liability for any delay, cancellation or damage arising in whole or in part from any act of God, act of nature, acts of civil or military authority, strike or labour dispute, mechanical failure, lack of essential supplies or parts or for any cause beyond the direct control of Stratajet or the air charter supplier.
Specifically:
a. Neither we or our air charter suppliers shall have any responsibility or liability for delay, cancellation or failure to furnish any service to be provided to you when caused by mechanical failures or defects, weather conditions, airport time slots, handling agent time slots, acts of God, war, civil commotion, strikes or labour disputes, government regulation, civil or military action, law, rule or authority, or any cause beyond our reasonable control.
b. You assume all liability and responsibility for your safety, schedule, baggage, cargo, business and personal activities and financial ramifications associated with your bookings and travel arranged with us and performed by the air charter suppliers;
c. You, your agents, guests or passengers or any employees, if applicable, shall not engage in any act or possess any substance or allow cargo to contain any substance which may result in the seizure or forfeiture, or unsafe operation of the aircraft used in the charter contracted for you by us.
d. Stratajet makes no representation or warranties of any kind, either express or implied, as to any matter limited to, implied warranties of fitness for a particular purpose, merchantability or otherwise.
e. If your journey involves a destination or stop in a country other than the country of departure, the Warsaw Convention may be applicable and the convention governs and in most cases limits the liability of the carrier for death or personal injury and for loss of or damage to baggage or cargo.
f. You shall indemnify and hold harmless Stratajet, its affiliates and all of their officers, directors, employees, legal representatives and other agents, successors and assigns (the "indemnified parties") from and against any and all liabilities, losses, damages, penalties, costs and expenses on account of any claim, suit, action, demand, proceeding or anything of a similar nature made or brought against any of the indemnified parties as a result of the services performed hereunder on your behalf.
g. In no event will Stratajet be liable for any type of indirect, incidental or consequential damages, whether arising in contract or in tort, exceeding the amount paid by you for the flight in question. You will indemnify and hold us harmless against any loss, damage or expense incurred by us by reason of any action or omission of you, your employees, agents and guests. Furthermore, you agree to pay for any damage to the charter aircraft caused by you, or any employee or guest of you, normal wear and tear excluded.
What regulations apply to these terms and conditions?
This agreement is subject to all the applicable laws, rules, regulations, approvals and certifications in effect from time to time including - but not limited to - those promulgated by applicable governments, aviation authorities and other bodies with jurisdiction relating to carriage of passengers and cargo which are imposed or required now or at any point in the future.
This agreement is governed by the law of England and Wales, and you will any claims made against us in relation to this agreement will be made in an English court. The illegality or non-validity of any paragraph, clause, or provision contained or referred to in this agreement shall not affect or invalidate any other paragraph or provision within it. It is understood and agreed that this agreement contains the entire agreement between you and us, with respect to the subject matter hereof. No terms or provisions of this agreement may be changed except in writing and when signed by both parties.
